These Terms & Conditions (“Terms”) govern all photography services provided by Sabiartistry LLC (“Provider,” “we,” “our”) to you (“Client,” “you”). By booking a session with Sabiartistry, you agree to the following:
1. Services
Pre-session consultation (by phone or email).
Session length: 1 hour for full photoshoots, 30 minutes for mini sessions.
Location: 1 agreed-upon location within the local area. Travel fees apply for outside areas.
Outfit changes: 1–2 permitted per session.
Delivery:
High-resolution downloads and a print release are included.
Add-ons (optional):
Extra time: $125 per additional 30 minutes.
Additional images: $15 per image or $100 per 10.
Travel fees: $35/day + lodging/transportation if required.
2. Payment Terms
Session fees:
Mini shoot: $175
Lifestyle shoot: $275
Branding shoot: $375
A non-refundable retainer of $175 is required to secure your booking.
Remaining balance is due on or before the session date.
Late payments incur a $25/week fee. Services (including gallery delivery) may be withheld until balance is paid.
Returned checks/failed payments incur a $35 fee.
3. Cancellations, Rescheduling & No-Shows
Retainers are non-refundable.
Cancellations must be communicated as soon as possible.
If we are able to rebook your date, a partial refund may be offered at our discretion.
No-shows or failure to communicate will result in forfeiture of all payments.
4. Exclusivity
Sabiartistry must be the exclusive photographer at your session/event. Other photographers, professional or amateur, may not interfere with our work. If disruptions occur, we reserve the right to stop services without refund.
5. Artistic Style
By booking, you acknowledge and trust our artistic style and creative discretion. While we will consider your preferences, final editing and aesthetic decisions rest solely with Sabiartistry. Dissatisfaction with artistic style is not grounds for refund.
6. Image Rights & Usage
Copyright: All images remain the property of Sabiartistry LLC.
License to Client: You are granted a personal-use license for prints, personal social media, and sharing with family/friends.
Credit: Please credit “Sabiartistry LLC” when posting online.
Commercial Use: Requires written permission and may involve additional fees.
Portfolio Use: We reserve the right to use images for marketing, portfolio, website, and promotional purposes.
7. Model Release
You grant Sabiartistry permission to use images containing you and participants (including minors, if applicable and with consent) for promotional, advertising, and editorial purposes.
8. Liability & Safety
Our maximum liability is limited to the total fees paid.
In rare cases of image loss/damage, partial refunds may be offered at our discretion.
Client assumes all risks associated with the session and is responsible for the safety and conduct of all participants/guests.
Provider may leave a session early if conditions are unsafe, disrespectful, or unlawful, without refund.
9. Delivery & Editing
Final galleries are delivered digitally within the agreed timeline.
Files remain available for 30 days only—please download and back up promptly.
RAW/unretouched files will not be provided.
Editing includes standard color, lighting, and basic retouching. Extensive edits (object removal, body modifications, etc.) are not included and may be subject to additional fees.
10. Force Majeure / Provider Inability
If circumstances beyond control (illness, emergency, natural disaster, etc.) prevent performance:
We will attempt to reschedule or provide a replacement photographer (with your approval).
If impossible, a refund will be issued for services not rendered.
11. Dispute Resolution
Should a dispute arise between Provider and Client, the parties agree to attempt to resolve by good-faith negotiations and discussions. Client agrees that failure to see results is not a basis for a “dispute” and agrees he, she, or they does not hold Provider responsible for any specific results, or those results which have been achieved by other clients of Provider. If unable to reach a resolution informally, Client and Provider agree that all disputes will be submitted for Arbitration by the American Arbitration Association, to be completed in Ohio, within a reasonable amount of time. Client and Provider agree to participate in the arbitration process in good faith and in a manner that will effectively and efficiently resolve the dispute at hand, including the exchange of any materials, documents, or information. The decision made by the arbitrator is to be final and binding on both parties, and is not to be appealed or otherwise set aside. It is to be enforceable in any court of proper jurisdiction as a judgment of law or decree.
12. Governing Law
This Agreement shall be governed by the laws of Ohio regardless of conflict of law principles, and regardless of location of Client. Client understands this and agrees that the laws of Ohio are to be applicable here.
13. Acceptance
By booking a session and paying your retainer, you confirm that you have read, understood, and agree to these Terms & Conditions.
